TERMS AND CONDITIONS

1. Scope of Application

1.1 These General Terms and Conditions apply to the entire business relationship, including future contracts, between the guest (hereinafter referred to as the “Guest”) and Hotel Berial, Gartenstraße 30, 40479 Düsseldorf, Germany (hereinafter referred to as the “Hotel”).

 

They apply in particular to contracts for the rental of hotel rooms for accommodation purposes as well as to all related services provided by the Hotel.

 

1.2 General terms and conditions of the Guest shall not apply. They are hereby expressly rejected.

2. Conclusion of Contract

2.1 Offers made by the Hotel are subject to change and non-binding.

 

2.2 The contract is concluded once a room has been booked by the Guest and confirmed by the Hotel.

 

2.3 If the person making the booking is not the same as the person using the accommodation, both the booking party and the user shall be jointly and severally liable to the Hotel for all obligations arising from the accommodation contract.

 

2.4 The Hotel is entitled to request an advance payment, credit card guarantee, or security deposit to secure the reservation.

3. Provision and Return of Rooms

3.1 Reserved rooms are available to the Guest from 3:00 PM on the day of arrival.

 

3.2 Unless a later arrival time has been expressly agreed, the Hotel reserves the right to allocate reserved rooms to other guests after 6:00 PM if no sufficient guarantee (e.g., credit card or advance payment) has been provided.

 

3.3 There is no entitlement to the provision of specific rooms or room categories.

 

3.4 Subletting or re-letting the rooms provided, as well as using them for purposes other than accommodation, requires the prior written consent of the Hotel.

 

3.5 Upon arrival, the Guest must present valid identification and complete and sign the legally required registration form.

 

3.6 On the day of departure, the rooms must be vacated no later than 11:00 AM.

 

3.7 If the room is used beyond this time, the Hotel may charge additional fees.

4. Cancellation

4.1 Reservations are binding for both contractual parties.

 

4.2 Free cancellation is only possible if this has been explicitly agreed upon at the time of booking.

 

4.3 In the event of a late cancellation or failure to arrive, the Hotel is entitled to charge up to 90% of the agreed accommodation price, provided the room cannot be re-let.

 

4.4 The Guest reserves the right to prove that the Hotel suffered no damage or significantly less damage.

5. Prices and Payment

5.1 The prices agreed at the time of booking shall apply.

All prices include the applicable statutory value-added tax (VAT).

 

5.2 The Hotel may require an advance payment or security deposit upon conclusion of the contract.

 

5.3 Invoices issued by the Hotel are payable within 10 days of receipt without deduction.

 

5.4 The Guest may only offset claims if such counterclaims are undisputed or have been legally established.

6. Withdrawal by the Hotel

6.1 The Hotel is entitled to withdraw from the contract for good cause. Such cause exists in particular if: agreed advance payments are not made force majeure or other circumstances beyond the Hotel’s control make contract fulfillment impossible rooms were booked using misleading or false information the stay endangers the smooth operation, safety, or reputation of the Hotel.

 

6.2 In such cases, the Guest shall have no claim for damages.

7. Liability

7.1 The Hotel shall be liable in accordance with statutory provisions.

 

7.2 For items brought into the Hotel by the Guest, the statutory liability provisions shall apply.

 

The Hotel recommends storing valuables in the hotel safe.

 

7.3 The Hotel assumes no liability for vehicles parked on the hotel premises or nearby, except in cases of intent or gross negligence.

 

7.4 The Guest shall be liable for any damage caused by themselves or their accompanying persons.

 

The loss of a room key may be charged with a flat fee of €100.

8. House Rules

8.1 The Guest agrees to comply with the Hotel’s house rules.

 

8.2 To ensure the comfort of all guests, quiet hours apply from 10:00 PM.

 

8.3 In the event of serious violations of the house rules, the Hotel is entitled to terminate the accommodation contract without notice.

9. Place of Performance, Jurisdiction, Applicable Law

9.1 The place of performance and payment is the registered office of the Hotel in Düsseldorf, Germany.

 

9.2 German law shall apply exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

 

9.3 Should individual provisions of these General Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
